This is an agreement between ElderNode "Limited Liability Company" and you ("You," "Your" or "Customer").
This agreement has been approved by you if you order and receive services from ElderNode, and it includes several sections, which you can see below.
All services defined on the ElderNode website are listed in full and clearly for a fee. Services are as follows.
1.a– VPS and dedicated server service are daily (24 Hours), monthly (30 days), 3 months (90 days), 6 months (180 days), annual (365 days), and biennial (730 days), and the fee for these services is based on It only provides that service and does not include other management and monitoring services.
1.b– Management and security services are paid once and the user can request the service at the beginning or during the period of using the service and no additional fee will be received except for the listed cost.
1.c– Server management and monitoring services are provided on a monthly basis and the cost received is different from the cost of virtual or dedicated server service. All costs will be received according to the plans listed on the site and no additional costs are included.
The delivery system in ElderNode is in different forms in the offending services, which are listed separately for each service when ordering.
2.a– The virtual server service is in Instant delivery and the service will be delivered in less than 30 minutes after ordering. After the order is ready, the login information will be emailed to you.
Note: Delivery of Windows Virtual Server in Singapore, Hong Kong, Australia, and Japan will take between 4 to 6 business hours.
2.b– Dedicated servers will take between 3 to 10 working days depending on the location and preparation of the servers, and you should pay attention to the delivery time when ordering. The delivery time of all servers is fully listed in the plans. After the order is ready, the login information will be emailed to you.
2.c– ElderNode server management services are instant and after ordering and sending server information from the user, the service admin will be specified and server management will begin.
2.d– Security and management services will be provided and delivered to the user in less than 12 hours after payment.
2.e– To order additional IPs on virtual servers, you can submit your request through the ticket so that after reviewing, additional IPs will be provided.
The payment service in ElderNode is in various forms so that users can pay for their orders in any way they like.
3.a– Perfect Money payment service transactions are instantaneous and after paying the order amount from this portal, your order will start to be prepared and delivered.
3.b– Transactions through the cryptocurrency gateway may vary depending on the type of cryptocurrency and require confirmation, which can sometimes take between 10 and 15 minutes. Paying through some cryptocurrencies, such as Bitcoin, may take longer due to network congestion.
3.c– Payment transaction via PayPal and other credit cards is done in a short time and the services, after confirming the payment from the payment gateway, start preparing and delivering.
3.d– There is no limit to charging an account in ElderNode, and users can top up their account as much as they want and pay their service invoice instantly.
All services in ElderNode have a service renewal alert message. The service renewal message will be sent to users via email 10 days before the end of the service. To use the service on a regular basis, the user must pay his bill before the time expires. Otherwise, the system will automatically suspend the service at the time of maturity and will be terminated automatically after 4 days, and a new service will be provided to the user at the request of the user.
5.a– ElderNode virtual server services have a 7-day money-back guarantee in case of user dissatisfaction. If you are not satisfied with our service in the first 7 days of the service for any reason, you can send a cancellation and refund request. If we are unable to resolve your problems or concerns, you will be refunded.
Note: Please note that transfer costs per refund may be as high as $5 to $10.
5.b– All payments to ElderNode except the 5.a rule are non-refundable. This includes the one-time setup fee and subsequent charges regardless of usage. All overcharges or billing disputes must be reported within ten (10) days of the time the dispute occurred. If the Subscriber disputes a charge made to his/her/its credit card that, in the Company’s sole discretion, is a valid charge under the provisions of the TOS.
5.c– If the user buys a service and it is not available at the appointed time or cannot be provided, the user can choose another service or request a refund, which will be possible by deducting the transfer fee.
The Company may temporarily deny Services to the Subscriber by placing the Subscriber’s account into a suspended state or terminate this Agreement upon the failure of the Subscriber to pay charges when due. Such denial or termination will not relieve the Subscriber of his/her/its responsibility to pay all accrued charges.
The Subscriber acknowledges that the Services provided are of such a nature that the Services can be interrupted for many reasons other than the negligence of the Company and that damages resulting from any interruption of the Services are difficult to ascertain. Therefore, the Subscriber agrees that the ElderNode shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the Company. The Subscriber further acknowledges that the Company’s liability for its own negligence may not, in any event, exceed an amount equivalent to charges payable by the Subscriber for the Services during the period damages occurred. In no event shall the Company be liable for any special or consequential damages, loss, or injury.
ElderNode provides 24×7 technical support to its Subscribers for managed and non-managed Services. The Company limits its technical support to the Services, being its area of expertise. The following are Eldernode’s guidelines when providing support:
8.a– Eldernode provides support related to the Subscriber’s hosting’s physical functioning.
8.b– Eldernode does not offer technical support for application-specific issues such as CGI programming, HTML, or any other such issue.
8.c– Eldernode does not provide technical support for applications or services that the user installs on virtual servers or dedicated servers.
8.d– All problems related to providing a virtual server or dedicated server due to infrastructure failure, ElderNode support will do it for free.
8.e– Some of the technical problems of infrastructure, which should be checked by the network administrator or server administrator, are done only during working time and may take between 6 to 12 hours.
In general, any abuse of ElderNode services to achieve unconventional purposes in which the server, service, site, or any node in the network is damaged, is considered abuse by ElderNode, and the service of users is suspended.
The following is a summary of each of them
9.a– DDOS attacks that are performed by ElderNode users from a VPS or dedicated server on the network and cause network disruption or damage to the company’s services and third-party services are considered as abuses and the service is suspended.
9.b– All phishing attacks carried out by virtual servers or dedicated servers will be abuse and the service will be suspended.
9.c– Port 25 is a bit sensitive in some locations, and if you plan to use these services, you should discuss it with the sales department when purchasing so that you can consider the service with less sensitivity on the SMTP port. Otherwise, unconventional use of the SMTP service and sending spam emails may detect abuse and suspend the user service.
9.d– Any port scan, vulnerability scan, brute force, flooding, mail bombing, crashing, and other similar attacks that take place on other people’s services and the victim (individual, company, organization) reports, your service will be detected as abuse and your service will be suspended
9.e– While users use their services, all responsibility for the service will be on the user and he must protect it against viruses, trojans, malware, rootkits, and other vulnerabilities. If an abuse service is detected for the above reasons, the user will be responsible.
10.a-ElderNode has no obligation to monitor the activities of each subscriber to determine if a breach has occurred. ElderNode is not responsible for monitoring or controlling Internet activity.
10.b– Any Subscriber, which ElderNode determines to have violated any element of the Company’s TOS, shall receive an email, warning him/her/it of the violation. The Services may be subject, at ElderNode’s discretion, to a temporary suspension pending a Subscriber’s agreement in writing, to refrain from any further violations.
10.c-Subscribers that ElderNode determines to have committed a second violation of any element of its TOS shall be subject to immediate suspension or termination of Services without further notice.
